Everyone Meet, Inc. Version 1.0 · Effective January 1, 2026
1. Introduction
Welcome to EOMEET. These Terms of Service ("Terms") are a binding agreement between you and Everyone Meet, Inc. ("Everyone Meet," "EOMEET," "we," "us," or "our") and govern your access to and use of the EOMEET mobile applications, website, and related services (collectively, the "Services").
By creating an account or using the Services, you agree to these Terms. Please also review our Privacy Policy, which explains how we collect, use, and share information. If you do not agree to these Terms, do not use the Services.
2. Eligibility and Accounts
2.1 General Accounts (18+)
General EOMEET accounts are for adults only. To create a general account, you must be at least 18 years old (or the age of majority in your jurisdiction, if that age is higher) and able to form a binding contract. We do not verify age; by creating a general account, you represent and warrant that you meet this requirement. General accounts are the standard way individuals and organizations use the Services.
2.2 Minor Accounts (Under 18)
The Services are not open to self-registration by anyone under 18. The only way an individual under 18 may access the Services is through a Minor Account that is created, owned, and controlled by an adult general-account holder (for example, a parent, guardian, or an authorized administrator of an organization such as a youth program).
By creating a Minor Account, the adult account owner:
- represents that they have the authority to do so and to provide any consent required by law on behalf of the minor;
- accepts responsibility for the minor's use of the Services; and
- agrees to these Terms on the minor's behalf.
Minor Accounts are limited by design. A Minor Account may only join groups that have been designated for participants under 18. Those groups are closed — they are not public, discoverable, or open to the general internet — and access to them is controlled by the organization or account that operates the group (the "Tenant"). Minor Accounts cannot access the general, adult areas of the Services.
We intentionally limit the information associated with a Minor Account to what the adult account owner provides and what is necessary to operate and secure the account and its participation in permitted groups. See the Privacy Policy for details.
2.3 Account Security and Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, including any Minor Accounts you own. Notify us promptly through the Contact us link on this page if you believe your account has been compromised.
3. The Services
EOMEET helps people and organizations coordinate real-world group activity — proposing options, gathering preferences, finalizing events, managing groups, communicating, and, where enabled, collecting payments. Features vary by plan and may change over time. We may add, modify, suspend, or discontinue features at our discretion.
4. Your Content
"User Content" means anything you or your groups submit through the Services — messages, event details, images, files, and similar materials.
You retain ownership of your User Content. You grant Everyone Meet a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and transmit your User Content as needed to operate, provide, secure, and improve the Services. This license ends when your User Content is deleted, except for content retained in backups for a limited period or as required by law, and except to the extent it has been shared with others who have not deleted it.
You are responsible for your User Content and represent that you have the rights necessary to submit it and that it does not violate these Terms or any law.
5. Acceptable Use and Prohibited Content
You agree not to, and not to permit anyone using your account to:
- violate any law or the rights of others;
- upload, share, or transmit content that is pornographic or sexually explicit, that promotes or depicts violence, or that constitutes hate speech, harassment, or threats;
- exploit, endanger, or sexualize minors in any way;
- impersonate any person or organization, or engage in fraud, scams, or deceptive conduct;
- use the Services to facilitate any unlawful transaction;
- post content that is defamatory, deceptive, or that infringes intellectual property or privacy rights;
- distribute malware or spam, or attempt to gain unauthorized access to the Services or any account;
- interfere with, disrupt, or reverse-engineer the Services, except to the extent this restriction is prohibited by applicable law.
We moderate content across the platform and may remove content or restrict, suspend, or terminate accounts that violate these Terms. Because moderation is not perfect and depends in part on user reports, we do not guarantee that all prohibited content will be identified or removed immediately. 6. Groups, Organizers, and Tenants
Users who create and administer groups and events ("Organizers" or "Tenants") are responsible for their groups, including membership, the content shared within them, and compliance with applicable law. Tenants that operate groups designated for participants under 18 are responsible for controlling access to those groups and for obtaining any consents required for the minors they admit. Everyone Meet provides the tools; the Tenant controls the group.
7. Payments and Subscriptions
Some features require a paid subscription or involve payments. If you purchase a subscription or process payments through the Services, you agree to the applicable pricing, billing, and refund terms presented at the time of purchase.
- Subscriptions renew automatically for the billing period selected until cancelled. You may cancel at any time, effective at the end of the current billing period. Except where required by law, payments are non-refundable.
- Commerce. Where the Services are used to collect payments (for example, dues, tickets, or cost-splitting), a platform fee may apply as disclosed at the time of the transaction. Payments are processed by third-party payment providers subject to their terms.
- Our role. Unless expressly stated otherwise, EOMEET provides the technology that enables transactions and is not the seller or provider of the underlying event, membership, goods, or services offered by an Organizer or Tenant. Any dispute regarding those offerings is between the participant and the Organizer or Tenant.
- App stores. If you purchase through the Apple App Store or Google Play, that store's billing and refund terms may also apply.
- Taxes. You are responsible for any applicable taxes.
We may change prices with reasonable advance notice; changes apply to the next billing period.
8. Intellectual Property
The Services, including all software, design, text, graphics, and trademarks (other than User Content), are owned by Everyone Meet or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Services without our written permission.
9. Third-Party Services and App Store Terms
The Services may integrate with third-party services (such as payment processors and messaging providers), which are governed by their own terms. If you access the Services through the Apple App Store or Google Play, you also agree to the applicable store terms, and you acknowledge that the store is not responsible for the Services.
10. Suspension and Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access to the Services, in whole or in part, if you violate these Terms, if we are required to by law, as reasonably necessary to protect the Services or other users, or for other legitimate business reasons.
If we become aware that a general (adult) account has been created or used by someone who does not meet the age requirement in Section 2.1, we will take appropriate action consistent with applicable law, which may include restricting or removing the account.
Termination does not relieve you of obligations incurred before termination. Any provisions that by their nature are intended to survive termination — including payment obligations, User Content licenses granted to others, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.
11. Disclaimers
The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any coordination outcome, event, or payment will occur as planned. Everyone Meet is not responsible for the conduct of any user, Organizer, Tenant, or third party.
12. Limitation of Liability
To the maximum extent permitted by law, Everyone Meet and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services. Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Everyone Meet and its affiliates, directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to any of the following: (a) your User Content; (b) the groups, events, products, or services you create, operate, or offer; (c) your violation of any law; (d) your violation of these Terms; or (e) your infringement or misappropriation of any third-party right.
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except where the mandatory law of your country of residence requires otherwise.
14.2 Arbitration and Class-Action Waiver
Except where prohibited by applicable law, any dispute arising out of or relating to these Terms or the Services will be resolved exclusively through binding arbitration administered by the American Arbitration Association under its applicable rules, seated in Colorado. You and Everyone Meet waive the right to a jury trial and agree that disputes will be brought only in an individual capacity and not as part of a class or representative action.
14.3 Consumers Outside the United States
If you use the Services as a consumer in the European Union, United Kingdom, Australia, Canada, Mexico, or another jurisdiction whose laws grant you non-waivable protections, nothing in these Terms removes the mandatory rights — or the right to bring proceedings in your local courts — that those laws provide. The governing-law and arbitration provisions above apply only to the extent permitted by that law.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, through the Services or by email). Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
16. General
These Terms are the entire agreement between you and Everyone Meet regarding the Services and supersede any prior agreements on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them, including in connection with a merger, acquisition, or sale of assets.
